Established under the Municipal Government Act of Alberta, the Subdivision and Development Appeal Board (SDAB) determines an appeal pertaining to the approval or denial of subdivision and development decisions made by the County.
Decisions of the Subdivision and Development Appeal Board are final and binding on all persons subject only to an appeal upon a question of law or upon a question of jurisdiction pursuant to section 688 of the Municipal Government Act, Chapter M-26, Revised Statutes of Alberta, 2000. Membership: The Leduc County SDAB consists of five members: two council members (who are not members of the Subdivision Authority) and three public members at large. Members of the Board are appointed annually by Leduc County Council. The chair and vice chair of the SDAB are elected annually by the members of the SDAB. Who can make an appeal? Subdivision applications can be appealed by the applicant, landowner, any applicable government department, Leduc County Council or a school authority regarding allocation of municipal and school resource, the land, or money in place of reserve. Development permit applications can be appealed by the applicant or any person who is affected by the permit or the decision. How do I file an appeal to the SDAB?
