What is the difference between a building permit and a development permit?

A development permit is issued when a proposed project complies with the requirements of the Land Use Bylaw. In the case of a discretionary use a development permit will be issued if the development authority is satisfied that the development meets the intent of the land use district, complies with other relevant statutory plans, is compatible with surrounding lands, and is connected to appropriate infrastructure. In very general terms, a development permit will approve the proposed use of a property and building (i.e. single family dwelling or manufacturing plant) and the setbacks from property lines to buildings. A building permit is issued when the proposed construction appears to comply with the Alberta Building Code and allows a safety codes officer to monitor construction for compliance with the Alberta Building Code. While a building permit is not a guarantee of quality construction or complete compliance with the Code, the monitoring process provides the applicant with observations noted during inspections and makes note of any required corrections.

When is a building permit required?

A building permit is required for the construction, alteration, installation, repair, relocation, demolition or change in occupancy or to any work to which the Alberta Building Code applies. The following are examples of construction requiring building permits:

  • Construction of a building, includes renovation, relocation of a building (i.e. mobile or modular home) or an addition to a building
  • Change in occupancy of a building (converting a building from one use to another)
  • Installation of a solid fuel fired appliance (wood or pellet stove)
  • Interior alterations (i.e. adding or removing walls, finishing a basement)
  • Construction or installation of above ground, on ground or in ground swimming pool with water depth greater than 600mm (24 inches) and any fence surrounding a swimming pool
  • Repair or restoration of a building, (i.e. following fire damage)
  • Construction of a deck
  • Alterations to heating/ventilation systems
  • Any construction where health or safety matters are a concern
A building permit is not required for:
  • Construction of an accessory building, for example a garden shed, that is less than 10 square metres (107 square feet) in size if there are no health and safety concerns
  • Painting, decorating, sidewalks, planters, driveways
  • Re-shingling
  • Construction of a farm building - the specific requirements that need to be met in order to designate a building as a farm building are contained on the Farm Building Confirmation form . Please complete this form and return it to Planning and Development for review

Who can obtain a building permit?

A building permit may be issued to the building owner, a contractor or other authorized applicant.

Inspections Required:

It is the responsibility of the permit applicant to contact Leduc County 48 hours in advance to arrange for the required inspections prior to covering the work. If work is covered prior to calling and receiving inspections a safety codes officer may ask that any work that required inspection be uncovered.
