Notice of public hearing: road closure bylaw and resolution to dispose of land for less than market value

Pursuant to Sections 22 and 70 of the Municipal Government Act, R.S.A. 2000, Chapter M-26, notice is hereby given of the intention of council to pass a bylaw to close portions of road described as:
A portion of the Government Road Allowance (0.57 ha) and portions of a Road Plans 607NY (0.10 ha) and 73NY (0.05 ha), adjacent to the West Boundary of the Southwest (S.W.) Quarter (1/4) of Section Nine (9), Township Fifty One (51), Range Twenty Four (24), West of the Fourth (4th) Meridian, and lying within the limits of Plan ______; containing a total of ±0.72 ha.
EXCEPTING THEREOUT ALL MINES AND MINERALS.
(the “bylaw”), and to pass a resolution to dispose of these portions of road at less than market value (the “resolution”).
Copies of both the proposed bylaw and proposed resolution are available for inspection at County Centre, located at 101-1101 5 Street, Nisku, AB, T9E 2X3, during regular business hours, Monday to Friday, 8:30 a.m. to 4:30 p.m.
Anyone wishing to file a petition regarding the proposed Resolution must do so in compliance with the requirements of Sections 222 – 226 and 231 of the Municipal Government Act, which include, but are not limited to, the following:
- The petition must be filed with the chief administrative officer of Leduc County within 60 days after the last date on which the proposed resolution is advertised;
- Only electors of Leduc County are eligible to be petitioners, and the petition must be signed by electors of Leduc County equal in number to at least 10 per cent of the population;
- Each page of the petition must contain an identical statement of purpose of the petition, the petitioner’s printed surname, given name and signature, the street address of the petitioner or the legal description of the land on which the petitioner lives, the petitioner’s telephone number and e-mail address, if any, and the date on which the petitioner signs the petition. An adult witness to the signature of each petitioner must sign opposite the petitioner’s signature and swear an affidavit that the petitioner is entitled to sign the petition. These affidavits must be attached to the petition. The petition must also have attached to it a signed statement of a person stating that the person is the representative of the petitioners and that the municipality may direct any inquiries about the petition to the representative.
The proposed bylaw is, however, not subject to a petition under Section 231 of the Municipal Government Act.
A public hearing regarding the proposed bylaw and proposed resolution will be held on Tuesday, June 5, 2018 at 1:45 p.m., or as soon thereafter as possible, in council chamber of County Centre, at which time written and oral submissions can be presented to council. In the event that the meeting does not take place on June 5, the public hearing will be held at the following meeting of council. Persons who claim to be prejudicially affected by the proposed road closure bylaw, or their agents, will be given an opportunity to be heard by council at this public hearing. Submissions may also be made by any other person whom council agrees to hear.
Any written submissions that are mailed or delivered to Leduc County at, 101-1101 5 Street, Nisku, AB T9E 2X3 or faxed to 780-955-8866 by 4:30 p.m. on Wednesday, May 30, 2018 will be included on the council agenda. If you make a written submission, the information you provide may be made public, subject to provisions of the Freedom of Information and Protection of Privacy Act.
