Bylaw 01-23 Public Works Committee and rescind Bylaw 16-18

At the Dec. 6, 2022 Governance and Priorities Committee meeting, resolution GP94-22 was approved to amend the Public Works Committee terms of reference to remove public members.

Administration recommended Council give first, second and third reading to proposed Bylaw 01-23 Public Works Committee and rescind Bylaw 16-18.

Council gave first, second and third reading to Bylaw 01-23.


Public hearing: Amend Leduc County Land Use Bylaw 07-08 – Rural Wedding and Agricultural Event Facility land use

A public hearing was held at 1:46 p.m. regarding an amendment to the Land Use Bylaw related to rural wedding and agricultural facility land use.

Administration provided a presentation and recommended:

  • that Council provide first, second and third readings to the proposed bylaw to amend Section 9.13 of the Agricultural District and Section 9.2.3 of the Agricultural/Country Residential Transitional District to remove Rural Wedding and Agricultural Event Facility from the districts as a discretionary use; and
  • to add Section 9.1.8 to the Agricultural District regulations to allow existing Rural Wedding and Agricultural Event Facilities, which are subject of a current development permit approval, to remain within the district as a discretionary use.

Afterwards, Mayor Doblanko called on the following registered speakers to speak to the subject:

  1. Karen Neilson, Leduc County resident, provided a written submission in favour of having the rural wedding and agricultural event venues removed from the Leduc County Land Use Bylaw 7-08.
  2. Kevin Neilson, Leduc County resident, provided a written submission in support of the removal of rural wedding and agricultural event venues from the Leduc County Land Use Bylaw.
  3. Joan Michelle Mitchell, Leduc County resident, provided a written submission providing the impact that a rural wedding and agricultural event facility has had on the quality of life causing significant distress, concern, fear and has dramatically taken away the quality of life. The biggest concern is for the safety and well-being of animals and livestock.

Next, Mayor Doblanko called upon anyone else in attendance to speak in support of or against the subject. The following County residents spoke to the subject:

  1. Jeanie Hope, Leduc County resident, providing comments in support of the continued use of these types of venues with restrictions.
  2. Rod Bargen, Leduc County resident, provided comments against the subject.
  3. Candyce Bathelt, Leduc County resident, provided a written submission expressing concerns about the bylaw and not supporting the change.

Administration then provided closing comments in response to questions by Council.

The public hearing concluded at 2:23 p.m.


Bylaw 02-23 – Amend Leduc County Land Use Bylaw 07-08 – Rural Wedding and Agricultural Event Facility

Council gave first, second and third reading to Bylaw 02-23.


Bylaw 03-23 – Southern Country Residential Area Structure Plan (SCRASP)

The SCRASP was given first reading on Dec. 13, 2022 with the public hearing occurring on Jan. 24, 2023. On that same date, the bylaw was given second reading. Council expressed concerns about several clerical errors in the draft document before defeating third reading of the bylaw. Administration’s understanding is that Council wished to see the clerical errors in the document corrected prior to adoption of the SCRASP, therefore the updated document was presented for Council’s consideration on Feb. 14.

Administration provided a presentation on the Southern Country Residential Area Structure Plan and recommended Council provided first reading to Bylaw 03-23 – Southern Country Residential Area Structure Plan.

2022 year-end report for utilities

As part of the financial year-end process, administration was seeking approval for the year-end utility financial transactions. At year-end, a reconciliation is done on each utility in order to either transfer surplus revenue to reserves or fund a deficit. These transactions differed from what Council approved during the 2022 final budget process.

Administration recommended that Council approve the 2022 year-end financial transactions required as follows:

Year-end utility approval of transactions

  • Water: total of $1,309,267 contribution to reserves.
  • Wastewater: total of $593,204 contribution to reserves.
  • Solid waste – curbside pickup – contribution to operating rate stabilization reserve of $39,485.

Council approved the recommendation.


Seniors grant funding – 2023

The goal of the seniors grant program is to create deep community connection by supporting initiatives lead by regional community partners to meet the needs of Leduc County seniors.

Administration recommended Council approve the 2023 senior grant funding allocations as follows:

         1.          Calmar and District Seniors Citizens Club                                    $1,500

         2.          Cloverlawn Community Hall                                                            $1,000

         3.          Friends of the New Sarepta Library                                                $750

         4.          Glen Park Community Association                                                 $1,500

         5.          Leduc and District Seniors Centre - expo                                      $500

         6.          Looma Good Deed Association                                                       $1,000

         7.          Calmar Public Library (Community in the kitchen)                      $1,500

         8.          New Sarepta Golden Pioneers                                                        $1,500

         9.          Rolly View Community Association                                               $1,000

        10.       Sandholm Art Information Individuals                                            $1,000

        11.       Telford Community Club                                                                    $1,000

        12.       Telfordville Community Association                                               $1,000

        13.       Thorsby Pickleball Club                                                                     $750

        14.       Warburg Senior Citizens Club                                                          $1,000

Council approved the recommendation.


Wildland Meadows Local Improvement – wastewater treatment system

A local improvement plan has been developed to fulfill the requirements of a petition submitted by the residents of Wildland Meadows for the construction of a wastewater treatment system for Wildland Meadows.

A local improvement is a project that benefits a specific area more than the municipality as a whole. It is typically undertaken near or adjacent the benefitting area and is paid, in whole or in part, by benefitting property owners through a local improvement tax.

Administration recommended Council approve the Wildland Meadows Local Improvement Plan – wastewater treatment system dated Feb. 7, 2023.

Council approved the recommendation.

With this approval, administration will provide notice to Wildland Meadows residents, which will include copies of the local improvement plan, followed by a presentation of the plan to residents. Wildland Meadows residents will then have 30 days after being sent notice of the proposed local improvement tax to file a petition against the local improvement to stop the process.


Wildland Meadows Local Improvement – internal road hot-mix paving

A local improvement plan has been developed to fulfill the requirements of a petition submitted by the residents of Wildland Meadows for the hot-mix surfacing of the internal road for Wildland Meadows.

Administration recommended Council approve the Wildland Meadows Local Improvement Plan – internal road hot-mix paving dating Feb. 7, 2023.

Council approved the recommendation.

With this approval, administration will provide notice to Wildland Meadows residents, which will include copies of the local improvement plan, followed by a presentation of the plan to residents. Wildland Meadows residents will then have 30 days after being sent notice of the proposed local improvement tax to file a petition against the local improvement to stop the process.


Nisku District South Fire Station – award project

During the 2023 budget process, Council approved funding for the construction of a new fire station to protect the Nisku Business Park, Edmonton International Airport and the central region of the County with a full-time firefighting crew.

In Dec. 2022, administration posted a public request for proposal to Alberta Purchasing Connection and the Leduc County website. Three bid proposals were received and reviewed by the evaluation committee.

Administration recommended Council approve to enter into an agreement with Scott Builders Inc. as the design build contractor for the Nisku District South Fire Station as per the approved budget of $7,850,000.

Council approved the recommendation.


Leduc County Emergency Management Regional Agency progress update

The Local Authority Emergency Management Regulation (LEMR) requires an annual review of the municipal Emergency Management Program by the Leduc County Emergency Management Agency and the Alberta Emergency Management Agency. The review was completed on Dec. 16. The LEMR also requires a municipality to engage in at least one tabletop exercise annually and a functional exercise every four years. Leduc County conducted its functional exercise on Oct. 24, 2022.

Fire Services Deputy Chief of Training and Emergency Management Ivana Irwin provided a report on the Leduc County Emergency Management Regional Agency progress update.

Ms. Irwin recommended Council accept the verbal Leduc County Emergency Management Program and Alberta Emergency Management Agency (AEMA) annual program as information; and approve the Municipal Emergency Plan After-Action Report for the Oct. 2022 functional exercise and the Leduc County Emergency Management Agency year-end report.

Council approved the recommendation.
